Court of Justice of the European Union: Lithuanian judicial experience is positive
Judge Egidijus Jarašiūnas from the Court of Justice of the European Union (ECJ) accompanied by Legal secretaries of ECJ Deimilė Prapiestytė and Mantas Stanevičius, and a Head of Directorate General Translation of Lithuanian Translation Unit Marija Anciuviene visited Supreme Court of Lithuania.
In short presentation judge Egidijus Jarašiūnas presented the most significant cases and discussed the issues of ECJ jurisprudence. According to the guest, the ECJ currently faces constant increase of incoming cases. "The ECJ from the architect becomes a jeweler. Compared even with the most famous cases of the decade, today's small cases - extremely important for each EU Member State" - emphasized the professor.
Deimile Prapiestyte (who presented a topic about preliminary ruling at ECJ) pointed out that all requests submitted by Lithuania to the ECJ were accepted. “This shows good quality of Lithuanian references to the ECJ and means that the specialists who prepare the requests are highly qualified lawyers who take due consideration and are well aware of the requirements which are applicable to preliminary ruling procedure before the ECJ”- noted the rapporteur.
According to the President of the Supreme Court of Lithuania Rimvydas Norkus - Lithuanian courts more often and with more confidence requests preliminary ruling from the ECJ. "Each request to the ECJ is very important and significant for Lithuania, because it often touches highly sensitive issues of social well-being” - stressed the president of the cassation court.
During the meeting the role of national courts and how do they apply EU Competition law, as well as the importance of the multilingualism in the ECJ and its practical implementation was discussed. What is more, the book "Important issues of the ECJ practice (2004-2014)” was introduced to the attendees.
It may be recalled that there are some important cases awaiting for their final adjudication in the Supreme Court of Lithuania following the judgements of the ECJ, e.g. the case of depositors of bank “Snoras”. In autumn, hearing in “Gazprom” case will be renewed. The Supreme Court of Lithuania is still waiting for clarification from the ECJ concerning air passengers' rights, public procurement directive and transport insurance.
