Dr Danguolė Bublienė, President of the Supreme Court of Lithuania, met with Justas Kidykas and Aušrinė Diržinskaitė, officers of the European Commission responsible for the Digital Services Act in Lithuania.

During the meeting, the participants discussed the European Union’s Digital Services Act (DSA), the EU regulatory framework aimed at creating a safer, more transparent and accountable digital environment. The discussion focused on the application of the DSA, the protection of individuals’ rights in the digital environment and related issues.

Dr D. Bublienė, President of the Supreme Court of Lithuania, presented the key conclusions of her report delivered at the Network of the Presidents of the Supreme Judicial Courts of the European Union. In her presentation, she analysed how the DSA operates and is applied by the courts, the current practice surrounding this regulatory framework and, most importantly, what is still needed to ensure its effective implementation in practice.

“At present, there is not yet extensive case-law, but a significant challenge is becoming apparent: illegal content is assessed differently across different countries. What is considered illegal content in one EU Member State may not necessarily be regarded as such in another,” said Dr D. Bublienė.

A separate but equally important issue was also discussed: how the protection of courts and judges in the digital environment should be ensured when illegal content or coordinated attacks are directed not only against a particular individual but also against the justice system itself. This is increasingly becoming an issue of judicial independence and public trust in justice.

In the view of Dr D. Bublienė, it is important, in implementing the Regulation, to ensure a safer digital environment in which individuals are protected from illegal content while at the same time preserving the right to freely express their opinions.
